proof of consent

by jane / Posted 13/04/2011 / Updated 15/04/2011

My ex has allowed me and child to return home, permanently, what do I need to show proof of this. I dont have representation, I am due to fly in just over a week. I dont think my ex would try and get me to leave without paperwork so he could get me in trouble with hague (again)- i already left and was returned. But i want to be sure. he says his lawyer will put the consent order in with the divorce and custody will be handled at the same time but were running out of time. Would a notorized letter signed by both saying the date we are leaving and that we will stay there indefinately be enough? atleast until an actual order is made? Im still hoping that order will be done in time, but I want a backup, I thought the letter would be enough to prove he knew we were moving, plus the flight was booked using his debit card and if we left he would have had to get his lawyer to release our passports. So at the very least he cant say he didnt know about the flight, he could still say he didnt know it was permanent. like i said I dont think he would do this but I worry about him changing his mind once were gone.

Just to add he is planning to move once he has sorted stuff over here,so im not just taking her away from him, and she is starting school at the end of the month and thats why we are leaving without him, plus I have a house ect waiting that wont wait until hes ready.
