Parental Authority

by Heidi / Posted 21/03/2013 / Updated 12/04/2013

Hi there,

my ex partner and I have a child together and our child was born in the UK but we later moved to The Netherlands. In the UK my ex partner has parental authority over our child. Can someone tell me if the parental authority over our child carries over to Dutch law considering it is all part of the EU, because in The Netherlands as we were not married means that my ex does not automatically have parental authority over our child under Dutch law and would need to apply through the court. The question here is - does UK law prevail or Dutch law should I choose to relocate to another country. Hope this makes sense:)

Many thanks
