What Prevention Measures To Take?

by Elly / Posted 13/08/2014 / Updated 29/08/2014

I have a one year old son with my husband who is Moroccan. He still lives over there because we donīt meet the minimum income requirements for a settlement visa. This has made my husband frustrated and angry and that puts a huge strain on our relationship, we werenīt even speaking to each other when our son was born and so he didnīt know about the birth for some time afterwards. He is named as the father on the Birth certificate at the instruction of the registrar.
Iīve been trying to find out the answers to some questions for a long time in order to protect my son but have always been given conflicting information so anyone who knows any of the answers Iīd be very grateful if you would reply thanks.
What I would like to know is:
If my husband came to the UK for a visit would he be legally able to take our son out of the country with out my consent?
Does he have PR or could he get it seeing as he doesnīt reside in the UK?
Could he obtain a Moroccan passport for him with out my consent?
If I get our son a British passport does that prevent the issue of a Moroccan one?
Does our son have automatic Dual Nationality and if not can I refuse consent to that or prevent it happening?
How do I find out my own rights eg do I have sole custody or is it joint, etc?
I donīt have any immediate cause for concern or reason to believe he would try to take our son but these new income rules have caused a great deal of friction between us and fear in my husband and so I need to prepare for any eventuality want to prepare for any eventuality.
Hoping someone can help
