Custody battle in USA

Hi there, my daughter and I moved to the UK to be with my husband a UK citizen when she went to visit her father in America she said she decided to stay at 12 years old we felt that since she never lived with her father she wanted a closer relationship 9 months later we found out he had made her say she wanted to stay that the second she got there he enrolled her in school and made her tell us she wanted to stay. Once we heard this, being the sole legal guardian and him never having ever had custody I had my parents show him a notarised document stating she was now living with them until we sorted everything through Hague. He was able to get a judge to give him emergency custody and the only way to get his emergency custody terminated is if I go over and speak to a judge there. The only thing I am worried about is that if I go over and they and they return custody to me what will happen regarding The Hague convention? Will I still be able to go through with The Hague convention or will I have to go through the local courts regarding having her return with me to the UK as he has her passport and I doubt very much he will let her come back.
