Hague case response

by William / Posted 11/07/2017 / Updated 13/07/2017

I never thought I would be posting in a forum like this but my wife has wrongfully retained our daughter in the UK. She recently obtained a prohibited steps order which prohibits me from removing our daughter from my wife´s care. So much of her statement was completely fictitious.

I have sought return under the Hague Convention and my wife is shortly due to submit her defence. I then respond one week after that with the final hearing two weeks later.

I expect that my wife will defend on the basis of consent, acquiescence and/ or intolerable situation. I will strongly contest each. Given I only have one week to prepare my response I would really appreciate if other parents who have been through this process could advise what I should be preparing at the moment to assist in my defence. Is there any evidence I should be gathering? My solicitor said to wait and see what the defence contains but I am concerned that I will only have one week for my response and want to be sure I respond the very best that I can. There is too much at risk to leave it to the last minute.

I am still in complete shock that she has taken our daughter like this and seeks to exclude me from any meaningful relationship with our daughter. If she had just spoken to me I am sure we could have come to an amicable arrangement and avoided all the stress which a Hague Case brings.

Thank you for any assistance and good luck to all trying to have their children returned.
