International Judicial Conference on Cross-Border Family Relocation

The International Centre for Missing & Exploited Children and the Hague Conference on Private International Law hosted a conference for over 50 judges and experts from 14 countries, including reunite, which addressed the issues surrounding cross-border family relocation.
The number of cases coming before Judges seeking relocation of a child/children from the Jurisdiction are increasing globally, with these cases posing a daunting legal challenge. Often the outcome of these cases differs greatly depending on the Judge hearing the case, the court, and the country in which the application is made.
At the close of the 3 day conference a document entitled "Washington Declaration on International Family Relocation" was issued and adopted by the judges. This declaration aims to provide a framework outlining the issues that should be considered by all judges in an effort to standardise how these cases are dealt with. The declaration gives thirteen recommendations including:
- The best interests of the child should be the primary consideration;
- Mediation and similar facilities to encourage agreement between the parents should be promoted and made available;
- Reasonable notice should be given prior to relocation;
- Every state should have legal procedures that address the right to relocate with a child.
