In 2019 we submitted an Amicus Curiae brief to the US Supreme Court in the case of Monasky v Taglieri. The court were being asked to decide on how the US courts should interpret habitual residence. The opinion of the court has been released, and it brings the US interpretation in line with UK & other treaty partners. We believe this is a very positive step. The court relied on our brief analysis in their decision-making, so we are pleased our contribution was helpful.
We would like to thank Anne-Marie Hutchinson OBE QC (Hon) of Dawson Cornwell, Edward Devereux QC of Harcourt Chambers and Kelly Powers, Stephen Cullen and Leah Hauser of Miles & Partners for representing us Pro Bono.
